On confirming the statutes of the Management of Trakai Historical National Park

On the basis of the Statutes of Trakai National Historical Park, as confirmed by LR Government Resolution 388 On Confirmation of the Trakai Historical National Park Statutes, dated April 4 2000 (Valstybės žinios 2000, No. 30-834), paragraph 14, article 2 and taking note of material presented by the director of Trakai Historical National Park, I CONFIRM the Statutes of the Management of Trakai Historical National Park (appended).

THE STATUTES OF THE MANAGEMENT OF TRAKAI HISTORICAL NATIONAL PARK

I. General Points

1. The Management of the Trakai Historical National Park (henceforth: the Management) is a state-funded body which organises the activities of Trakai Historical National Park and takes care of its protection and use according to purpose.

2. the Managment is a body at law with a seal bearing its name, current litas and foreign currency accounts in a selected Lithuanian Republic bank and with the permission of its founder it may have a bank account in any ONE foreign state.

3. the founder of the Management is the Minsitry of Culture

4. the Management's premises lie at Karaimų St. 5 in the town of Trakai, Region of Trakai, District of Vilnius

5. the Management statutes are presented by the director for confirmation by the minister of culture

6. the Management's activity is based on the Constitution of the Lithuanian Republic, the Protected Territories Law, the State-Funded Bodies Law, the Property of Cultural Value Protection Law and other laws and legal acts, the Trakai Historical National Park statutes and these statutes.

II. Aims and Forms of Management Activity

7. the aim of the Management's activities is to implement the tasks for wich provision is made in the Trakai Historical National Park Statutes

8. the Management, when implementing the tasks entrusted to it:

8.1 presents proposals in the manner established to the Govt of the Republic of Lithuania for the use of land, forest, waterways and recreational infrastructure

8.2 establishes the way in which visits may be made to Trakai Historical National Park territories, strict reserves and reserves;

8.3 oversees the economic and recreational activity of individuals and bodies at law throughout Trakai Historical National Park territory and that of its protection zones;

8.4 files legal cases for infringement of Trakai Historical National Park statutes and use of its territories and protection zone as laid down in LR Law;

8.5 acts as commissioning agent to draft territorial planning documents on maintaining Trakai Historical National Park territory and protection zones, cultural heritage and nature protection issues and presents them for confirmation in the set manner;

8.6 guided by the requirements of the Law of the LR, other legal acts and territorial planning documents, it sets special conditions to be respected in drafting territorial planning documents, projects for constructing buildings and other objects, roads, engineering communications and other items, approves drafted projects and land- and forest- maintenance plans;

8.7 submits Trakai Historical National Park activity and special purpose programmes, and annual reports on how these have been implemented to the Ministry of Culture for confirmation;

8.8 carries out other functions provided for in the Trakai Historical National Park Statutes

III. Management Rights

9. While implemented the tasks entrusted to it, the Managements has the right to:

9.1 determine administration structure;

9.2 submit cultural programmes for funding from the Ministry of Culture;

9.3 set the price, costs and tariffs of paid services offered by the Trakai Historical National Park independently, except in those cases where the state regulates prices and other standards in accordance with LR laws;

9.4 draw up contracts and take on commitments;

9.5 pay for received goods, work and services carried out in any form of agreement that does not contravene LR legislation and other legal acts;

9.6 draw up expert committees to investigate activity issues;

9.7 arrange meetings, conferences, seminars on issues relevant to Trakai Historical National Park in areas of preserving and using cultural and natural treasures, historical landscapes.

IV. Management Property and Funds

10. the Management's property is property legally belonging to the state: buildings, premises, other basic items, land, inland waterways, forests, financial output and other property connected with the Management which the later controls, uses and has at its disposal as legal trustee:

11. the Management's income comprises:

11.1 State funds from the LR budget;

11.2 income from paid services

11.3 income gained from rental of premises, transport;

11.4 funds and property received as support;

11.5 other income which Lithuanian Republic Law does not forbid it to hold.

12. Management expenses comprise:

12.1 cost of paying employees' salaries and national insurance payments;

12.2 building maintenance costs;

12.3 expenses connected with Management activities;

12.4 other expenses

13. the Management's financial activity is overseen by the founder and other institutions appointed for that purpose by the Law of Lithuania

V. Organisation of the Management’s Work

14. The Management is headed by the director who is appointed and dismissed by the minister of culture in accordance with legislation.

15. the director:

15.1 heads the Management and is responsible for its work and the implementation of Trakai Historical National Park tasks;

15.2 confirms the Management administrative structure;

15.3 confirms the list of duties, the allotment of duties to levels and categories without exceeding the amount of funds set aside for wages, if the law does not provide otherwise;

15.4 confirms outlines of Management activity income and expenses, economic and financial statistical accounts;

15.5 in the manner laid down by legislation (s)he employs and dismisses Management employees, encourages them and penalises them;

15.6 allots powers, makes agreements in the Management's name;

15.7 confirms internal working rules;

15.8 issues orders and confirms other acts regulating Management activities based on orders which are incumbent on all Management staff;

15.9 makes sure that the law is upheld in Management activities and that it acts on Lithuanian Republic Govt decrees and other legal acts;

16. The TRAKAI HISTORICAL NATIONAL PARK has a council which advises the director. The director presents the members of the council and their working rules for confirmation by the minister of culture. The council may comprise between seven and eleven members and works for four years.

17. The council is headed by a chairman, elected on the majority vote of council members. The council may comprise representatives from Elektrenai and Trakai regional councils, the administration of the head of the Vilnius District, from the Environment Ministry's Forests and Protected Territories Dept, the Ministry of Culture, the State Monument Maintenance Commission, companies carrying out monument preservation functions, independent experts and representatives of the general public from the Trakai Region.

18. the Council:

18.1 analyses and assesses processes under way within the Trakai Historical National Park and its protected zone, investigates proposals and makes proposals to the Trakai Historical National Park Management concerning:

18.2 basis Trakai Historical National Park Management programmes;

18.3 economic activity on Trakai Historical National Park territory;

18.4 Trakai Historical National Park visitor regulations;

18.5 the drafting and implementation of general, special and detailed plans on Trakai Historical National Park territory;

18.6 funds needed to organise Trakai Historical National Park activities and implement Trakai Historical National Park tasks;

18.7 Trakai Historical National Park membership of national and international organisations.

VI. Working relations and wages

19. Management staff relations are regulated by the LR Civil Service Law, the Labour Contracts Law and other legal acts. Management staff wages are set in the manner established by the Ministry of Culture.

VII. Reorganisation and liquidation of the Management

20. The Management may be reorganised or liquidated in the manner set down in the Law of Lithuania and other legal acts.
